Terms of Business

Cotswolds & Wyvern Computer Education Limited trading as ComputerXplorers Cotswolds and Wyvern, Company Registration Number 07965645 (The Company) undertakes to provide educational activities (Class or Workshop) to young people (Your Child) either after school, during school time or during school holiday periods.

The purpose of these Terms of Business is to explain to you what your rights and obligations are and what rights and obligations The Company has. The terms of this agreement are governed by English law and any dispute shall be resolved within the jurisdiction of the courts of England and Wales.

The Company also provides Classes paid for by an Establishment/Organisation and these are subject to a separate agreement that will be mutually agreed before the commencement of such Classes.

1. Fees and Payments for Classes paid for by Parents/Carers

  • The Company’s fees for providing a Class are as advertised on our website and on any promotional material relating to the specific class at the specific location.
  • For after school/extracurricular courses, unless otherwise agreed in writing payment will be required, in full before the start of any Class and before any place is reserved or allocated for Your Child on a Class.
  • In the event that The Company is unable to deliver a Class in full as described you will be notified immediately and given an immediate refund of all fees paid for the undelivered Class.
  • In the event that The Company is unable to deliver a Class in part you will be notified immediately and given details of any alternative Class. You will have the option to receive an immediate refund for the part of The Class not attended by Your Child if they are unable to attend the alternative Class.
  • If an After School Class is cancelled due to school closure or cancelled by the school, the class will be rescheduled where possible. This may include the use of lunchtime sessions or alternative days.
  • For a course to run there must be a minimum number of participants. Should the minimum number not be achieved you will be notified and a full refund given, if money has already been accepted.
  • No refunds will be made in the event that Your Child is unable to attend all or part of any Class that runs as advertised.
  • Payment can be made by debit card or credit card using our online facility at www.cotwoldsandwyvern.computerxplorers.co.uk. Payment by cash, cheque or bank transfer will be accepted only by prior arrangement with The Company.

2. Our Obligations

  • The Company undertakes to deliver Classes at the location, date and time displayed on its website and on any relevant promotional materials.
  • The Company will provide parent information sheets where appropriate to confirm the skills that have been developed in the Class.)
  • The Company will provide an attendance certificate for Your Child at the end of the Class.

  • The Company has Personal Accident Insurance of a maximum of £20,000 to cover claims in the event of an accident to an adult or child arising in Great Britain, Northern Ireland, the Isle of Man or the Channel Islands arising from action by it. The policy is currently with Sterling Insurance Company Limited and is arranged by Morton Michel of Alhambra House, 9 St Michaels Road, Croydon CR9 3DD.

  • The Company has Public Liability Insurance of £5million to cover claims and losses or damages in Great Britain, Northern Ireland, the Isle of Man or the Channel Islands arising from action by it. The policy is currently with Aviva Insurance Limited and is arranged by Sterling Insurance Company Limited and is arranged by Morton Michel of Alhambra House, 9 St Michaels Road, Croydon CR9 3DD.

3. Your Obligations

  • Provide The Company with contact details of any person(s) who should be contacted by it in the event of an emergency.
  • Provide The Company with the arrangements for the collection of Your Child from a Class.
  • Ensure that Your Child is at the required location on the required date and at the required time for a Class.

4. Complaints

  • If you are not happy with any aspect of service provided by The Company, you should first of all contact our Managing Director, Paul Sharpe whose telephone number is 01386 462051.
  • If you wish to make a complaint about any aspect of service provided by The Company, you must, in the first instance write to our Managing Director, Paul Sharpe at the address below. He will acknowledge your letter within 3 working days of receipt and then investigate the circumstances of your complaint and write to you with the results of his investigation within a further 28 days.
  • These complaints procedures do not prevent you from seeking other means of redress.

5. Contact Details

Notice of Your Right to Cancel - for Classes paid for by Parents/Carers

a) You have a right to cancel this agreement without giving any reason within 14 days of the accepting this agreement by writing to the Company at the postal address below or the email address above and you will not be required to make any payment and you will receive a full refund of any payment made less a proportionate amount for any Class that has already started, even if Your Child didn’t attend the Class.

b) You can cancel this agreement with The Company later than 14 days after accepting this agreement by writing to the Company at the postal address below or the email address above. If a Class has not started then you will not be required to make any payment and you will receive a full refund of any payment made. If the class has started then you will not be entitled to a refund unless the location, date or time of the Class has been changed by The Company.

c) Any refund will be made without delay and will be made using the same means of payment as was made for the Class unless You agree otherwise and you will not incur any fees as a result of the refund.

d) You can use the cancellation form below but you do not have to. Where notice of cancellation is posted, it is recommended that it is sent by Recorded Delivery, however cancellation will be deemed to be served as soon as it is posted or sent to The Company.

e) The Company will acknowledge receipt of notice of cancellation in writing within 14 days.

If you wish to cancel this contract, you MUST DO SO IN WRITING and deliver it personally or send (which may be by electronic mail) it to the Company named below. You may use this form if you want to, but you do not have to.
